1. Introduction and Acceptance of Terms

Welcome to Onyi! These Terms of Use (the "Terms") govern your access to and use of the Onyi website, mobile applications, and services (collectively, the "Service"), provided by a company built in Nigeria.

By accessing, browsing, or using the Service, you signify your agreement to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not use or access the Service.

2. Your Onyi Account

  • Account Creation: To use our Service, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
  • Account Security: You are solely responsible for safeguarding your password and for any activities or actions under your account, whether or not you have authorized such activities or actions. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to comply with these security obligations.
  • Eligibility: You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are of legal age to form a binding contract.

3. Gifting and Features

  • Gifts: The Service allows you to send various forms of digital gifts, including personalized notes, images, voice notes, and music playlists ("Gifts"). You are responsible for ensuring the accuracy of all recipient information (e.g., email address, phone number).
  • Features: Some premium features, such as sending anonymously or using the "Asking Question" feature, may be subject to additional fees. All fees are clearly disclosed at the time of purchase.
  • Date Setting: The Service allows you to set a specific date for an event to be associated with your gift. This is for informational and organizational purposes only and does not impact the delivery or availability of the gift.

4. User Content and Conduct

  • Your Content: You retain ownership of all content you submit to the Service, including photos, messages, and voice notes ("User Content"). By submitting User Content, you grant Onyi a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your User Content solely for the purpose of operating and promoting the Service.
  • Prohibited Conduct: You agree not to use the Service to:
    • Send any content that is illegal, defamatory, harassing, or otherwise objectionable.
    • Infringe upon the intellectual property rights of others.
    • Send spam, unsolicited messages, or marketing material.
    • Engage in any fraudulent or unlawful activities.

5. Intellectual Property

The Service, including its design, text, graphics, and software, is the property of Onyi and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our express written consent.

These Terms shall be governed by and construed in accordance with the laws of Nigeria, without regard to its conflict of law provisions.
